Liability for the use of ionizing radiation

According to the Radiation Act (859/2018) the responsible party is liable for safety in the use of radiation.

The responsible party has legal and administrative liability. Therefore, the responsible party must ensure that the right persons have the right positions in the use of radiation and that their authorities are appropriately defined. Additionally, the requirements for correcting deviations or compensating for accidents in the use of radiation, for example, are directed to the responsible party.

The responsible party is liable for the safety in the use of radiation

The responsible party may assign the practical matters related to radiation safety to a radiation safety officer or another appointed person. This does not, however, reduce the responsible party’s responsibility for compliance with the radiation legislation.

When applying for a safety licence, the responsible party appoints a radiation safety officer for whom it seeks STUK’s approval. The approval must be sought also if a new radiation safety officer is appointed. The radiation safety officer has a key role in ensuring radiation safety.

According to the Radiation Act, a physician must always assess the justification for an examination that causes exposure to radiation in advance, taking into account the purpose of the procedure and the status of the person in question.

Workers’ responsibility

Radiation workers must take care of their own and other persons’ safety and follow in their work the provisions of radiation legislation as well as the instructions provided by the responsible party and the radiation safety officer.
